Terms of Service

1. The Services

EnergyCheck provides software and professional services for building-envelope estimation, schedule-of-values preparation, and compliance documentation, including support for High-Velocity Hurricane Zone (HVHZ) requirements, Notice of Acceptance (NOA), and Florida Product Approval. The scope of any engagement is defined in a separate proposal, order, or written agreement.

2. Eligibility and accounts

You must be at least 18 years old and able to enter a binding contract to use the Services. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of any account credentials and all activity under your account.

3. Acceptable use

You agree not to misuse the Services, including by attempting to access them without authorization, interfering with their operation, reverse-engineering the platform, or using them to violate any law or the rights of others.

4. Client materials

You retain ownership of the plans, specifications, and other materials you provide. You grant us a limited license to use those materials solely to deliver the Services. You represent that you have the rights necessary to share them with us.

6. Fees and payment

Fees, including any paid pilot, are described in your proposal or order. Unless stated otherwise, fees are due as invoiced and are non-refundable once work has been performed. You are responsible for applicable taxes.

7. Intellectual property

The EC System platform, our methodologies, and all related software and content are owned by EnergyCheck and protected by intellectual-property laws. These Terms do not transfer any ownership in our intellectual property to you.

8. Disclaimers and limitation of liability

The Services are provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, EnergyCheck will not be liable for indirect, incidental, or consequential damages, and our total liability arising from the Services will not exceed the fees you paid for the engagement giving rise to the claim.

9. Indemnification

You agree to indemnify and hold EnergyCheck harmless from claims, damages, and expenses arising out of your use of the Services or your breach of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The state and federal courts located in Miami-Dade County, Florida will have exclusive jurisdiction over any dispute arising from these Terms or the Services.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
